Refund & Cancellation Policy
How cancellations, service concerns and refunds are handled for consumer and business engagements.
1. Who this policy covers
This policy concerns consultancy, development, implementation and support services supplied by ABHIKA AURA LTD, company number 17186771, based in Leeds, LS9 8FE. Contact insights@abhikaaura.com or +44 7442 302822.
A consumer is an individual acting wholly or mainly outside their trade, business, craft or profession. Business engagements are also subject to their agreed written project terms. Nothing here limits rights or remedies that cannot lawfully be excluded.
2. Consumer cooling-off period
For a qualifying service contract made online, by telephone or otherwise at a distance, or off business premises, a consumer normally has 14 calendar days after the day the contract is entered into to cancel without giving a reason.
The statutory period may be extended if required cancellation information was not supplied. We provide the relevant pre-contract information and confirmation before service delivery. An enquiry alone does not form a service contract.
3. Requesting an early start
If you want work to begin during the cooling-off period, we obtain your express request before starting and record it in writing. Where required for an off-premises contract, the request must be on a durable medium.
If you then cancel before full performance, you only owe a proportionate amount for services actually supplied up to the time you tell us you are cancelling, provided the required information and early-start request were obtained. The amount is based on the agreed total price, or the market value of the service where that price is excessive.
Reserved staff time or resources not actually supplied are not automatically chargeable under these rules. Where the law says no payment is due because the required request or information was missing, we do not deduct such a charge.
You lose this cancellation right after a service has been fully performed during the cooling-off period only if performance began following your express request and you acknowledged beforehand that full performance would end that right. Starting work alone does not remove the right to cancel.
4. How to cancel
Tell us clearly that you wish to cancel. Email insights@abhikaaura.com with your name, project or invoice reference and the service concerned. You may also use any other legally valid clear statement; no special wording or reason is required for a statutory cancellation.
Sending a notice before the cooling-off period expires is sufficient. Keep a copy for your records.
“I give notice that I cancel my contract for [service/project], agreed on [date]. My name is [name], my contact details are [details], and my reference is [reference].”
5. Refund timing and payment method
For a valid consumer cooling-off cancellation of a service, we reimburse sums due without undue delay and within 14 days after we are informed of the cancellation, less only a lawful proportionate charge under section 3.
Where a consumer is entitled to a refund following a statutory service price reduction, we pay without undue delay and within 14 days after agreeing that entitlement. We use the original payment method unless you expressly agree otherwise, and do not charge a refund fee.
Unused advance payments are reconciled against amounts properly due. We explain the calculation, including any lawful deduction.
6. Service quality and putting things right
We provide services with reasonable care and skill and in line with binding information and the agreed scope. If something appears wrong, contact insights@abhikaaura.com promptly with the affected deliverable, the problem and useful supporting details. There is no seven- or fourteen-day reporting cut-off that removes your statutory rights.
Where appropriate, we arrange repeat performance or correction at no extra cost, within a reasonable time and without significant inconvenience. This process does not make a second attempt a condition of every possible legal remedy.
If repeat performance is impossible or cannot be provided within a reasonable time and without significant inconvenience, a consumer may be entitled to an appropriate price reduction, potentially up to the full price. Other statutory remedies, including those for delay or breach of binding information, remain available. A legally required refund is not dependent on our sole discretion.
7. Other cancellations and business projects
Outside a statutory cancellation period, cancellation is governed by the accepted project terms and applicable law. Properly delivered, conforming work remains payable. We only charge for work, commitments or cancellation losses where lawfully recoverable, justified by the agreement and reasonable; savings and mitigation are taken into account.
Business clients do not have the consumer statutory cooling-off right. Their cancellation, milestone approval, notice and refund arrangements must be set out in the agreed statement of work or service agreement. A milestone approval does not excuse a breach of contract or remove rights that cannot be excluded.
We do not automatically treat every deposit or completed milestone as non-refundable in all circumstances. If we cancel, amounts paid for services we will not supply are reconciled and refunded as due.
8. Invoices, digital content and complaints
Our standard invoice term is payment within 14 days of issue, unless different terms were expressly agreed. This payment period is separate from consumer cancellation rights. Notify us promptly of an invoice dispute; undisputed sums remain payable.
Separately supplied digital content, software licences or mixed contracts may have different mandatory rules. We explain the relevant terms before supply and obtain any required express consent and acknowledgement; this service policy is not a blanket waiver of digital-content rights.
Send complaints to insights@abhikaaura.com. We investigate and explain our proposed resolution. If a consumer complaint remains unresolved after our internal process, we provide information about a relevant alternative dispute resolution body and whether we will participate, where required. You retain access to applicable legal remedies.
